Encompass Inc. (“Encompass, “we”, “our”, “us”) is committed to protecting your privacy and ensuring you have a positive experience on our website and in using our services (“Services”). This policy covers the Encompass website https://EncompassMovement.org, and pages hosted on any subdomain (our “Website”), and is applicable worldwide. When you visit our Website, we may collect personal information from you, either directly, or passively as you browse. Please read this policy to understand what personal information we collect and how we use it.

This policy outlines our handling practices and how we collect and use the Personal Data you provide during your online and offline interactions with us. As used in this Privacy Policy, ”Personal Data“ means any information that can be used to individually identify a person, and may include, but is not limited to, name, email address, postal or other physical address, credit or debit card number, title, and other personally identifiable information.

If you reside in the European Union (“EU”), United Kingdom, Lichtenstein, Norway, Iceland or Switzerland, you may have additional rights with respect to your Personal Data, as further outlined below. These rights may include rights under the EU’s General Data Protection Regulation (“GDPR”), if you are a resident of the EU, United Kingdom, Lichtenstein, Norway or Iceland.

Encompass will be the controller of your Personal Data that is provided, collected and/or processed pursuant to this Privacy Policy, except where otherwise expressly stated below. This means we make decisions about how and why your information is used, and have a legal duty to make sure that your rights are protected when we do so. This policy may be updated from time to time for reasons such as operational practices or regulatory changes. When we do, we will post a notification on the main page of our Website and we will also revise the updated date at the bottom of this page. We encourage users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we hold.

Collection of Personal Data

We collect the following categories of Personal Data about you when you use or otherwise interact with our Services:

  • Name

  • Preferred pronouns

  • Email addresses

  • Home/work/mobile telephone number

  • Postal or other physical address

  • PayPal, credit or debit card information

  • Facebook profile information (when you engage with our Facebook page, or if you make a donation through Facebook)

  • IP addresses and other information collected passively, as further detailed in the “Passive Collection” section below

  • Device identifiers, as further described in the “Mobile Application” section below

  • Professional career-based information, including, but not limited to, resume, employer, and career objectives.

Special Category Data (also known as sensitive personal information)

Unless you specifically provide it to us as part of your application to attend an event, we do not collect any special categories of personal information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership and information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. If you apply to join the Global Majority Caucus, we may store the information you provide to us about your race and ethnicity in order to process your application and provide services. If you apply to attend an event and have requested reasonable accommodations in connection with a disability, we may store the information you provide to us about your disability in order to provide those accommodations if we can.

Passive Collection

Encompass and our third party service providers automatically collect some information about you when you use our Services, using methods such as cookies and tracking technologies (further described below). Information automatically collected includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the website and/or Services.

In addition, when you use some of our Services, network information is transmitted back to us such as website usage information. This information is transmitted back to us so we can determine how users are interacting with our Services, to assist us with improving our Services, and to correct any problems that may occur.

Geolocation

We collect information about where you are located when you are using our Services. We use this information for purposes such as optimizing your connection to our data center and suggesting customizations to your experience with our Services (e.g. in-person events and trainings, etc.). We share this information with parties such as our data center provider. If you do not wish to allow us to share your information in this manner please opt-out by contacting us, read below for contact details.

Processing of Personal Data

We will use your Personal Data only in accordance with our Privacy Policy. If you do not wish us to continue using your Personal Data in this manner, you can request that your account be deactivated by contacting us as specified in the “Contact Us” section.

We will only process your Personal Data if we have a lawful basis for doing so. Lawful bases for processing include consent, contractual necessity (i.e. processing that is necessary for the performance of a contract with you, such as when you make a donation) and our “legitimate interests” or the legitimate interest of others (e.g. our users) such as:

  • Keeping our records updated and studying how our Website and other services are used

  • Administering and protecting the organization and web presence (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting)

  • Informing our marketing strategies

  • Serving our charitable aims in the most efficient manner possible

  • Personalizing, improving or operating our Services and business

  • Better understanding your needs and interests

  • Fulfilling requests you make related to the Services

  • Providing you with information and offers from us or third parties

  • Placing transactions or orders (for example, if we are giving away copies of a book and you request that a copy be sent to you, we will use the mailing address you provide)

  • Registering for a newsletter subscription

  • Using certain Website and Services features

  • Complying with auditing requirements

  • Making public reports about donations to Encompass (such reports will not directly identify you, but we will use your personal data when creating them)

When contacting you for any of the above purposes we may do so by phone or email, unless you tell us otherwise.

When you make a donation, the information you provide is passed to our payment processing partner to process according to our instructions. Your contact information is shared with Encompass. However, we will never store your card details – these are held by our third-party payment provider.

We may also ask for your date of birth, so that we can congratulate you on your birthday and let you know about birthday fundraising opportunities.

If you agree, we will send you periodic e-mails about Encompass’s activities, upcoming events, annual retrospectives and other information that we think you might be interested in. You can opt-out of receiving these e-mails at any time by clicking the appropriate link in the e-mail itself, or contacting us using the information set forth in the “Contact Us” section below.

Choice

You can choose whether to provide Personal Data to Encompass, but note that you may be unable to access certain options, offers, and services if they require Personal Data that you have not provided.

Data Subject Rights

You have certain rights with respect to your Personal Data as set forth below. Please note that in some circumstances, we may not be able to fully comply with your requests, or we may ask you to provide us with additional information in connection with your request, which may be Personal Data, for example, if we need to verify your identity or the nature of your request. In such situations, however, we will still respond to let you know of our decision.

  • Access: You can request more information about the Personal Data we hold about you. You can also request a copy of the Personal Data.

  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. Please contact us as soon as possible upon noticing any such inaccuracy or incompleteness.

  • Objection: You can contact us to let us know that you object to the collection or use of your Personal Data for certain purposes.

  • Erasure: You can request that we erase some or all of your Personal Data from our systems.

  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.

  • Portability: You have the right to ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another entity where technically feasible.

Cookies and Tracking Technology

A cookie is a small file of letters and numbers that we store on your browser or device, with your permission.

We use the following types of cookies:

Strictly necessary cookies. These are cookies that are required for the operation of our Website. They include, for example, cookies that enable you to log into secure areas of our Website or make a donation. However, if you block strictly necessary cookies, you may be unable to access certain parts of our Website.

Analytical/performance cookies. These cookies allow us to recognize and count the number of visitors and to see how visitors move around our Website. This helps us to improve the way it works, for example, by ensuring that users are finding what they are looking for easily.

We use third-party services such as Google Analytics to help us improve the look and feel of our Website. Google Analytics places a cookie on your browser which keeps track of certain details about your visit to our Website. These include what Google search criteria you used to find it in the first place, how long you stay on certain pages, and what website you visit immediately after leaving our own. This data will be aggregated and anonymized to the greatest extent possible.

Our Website does not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Website and after you leave it.

Sharing Your Personal Data

Your data will be treated in accordance with applicable data protection law. It will only be shared with third-parties as described in this policy.

We share Personal Data within Encompass, and with third party service providers in order to provide requested Services or transactions, including processing orders, processing credit card transactions, hosting websites, hosting events and seminars and providing customer support. We provide these third parties with Personal Data to provide the requested Services or complete the transaction.

We collect and possibly share Personal Data and any other additional information available to us in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Encompass’s terms of service, or as otherwise required by law.

We will never rent or sell your personal information.

Storage and Transfer of Personal Data

Our Services are hosted by Zoho and operated in the United States (US), the European Economic Area (EEA) and other countries where Zoho operates, through Encompass and its service providers. We may transfer your Personal Data to third parties acting on our behalf for the purposes of processing or storage. By using any of our Services or providing any Personal Data for any of the purposes stated above, you consent to the hosting, transfer and storage of your Personal Data, whether provided by you or obtained through a third party, to the US, the EAA or to other countries as set forth herein.

We collect and store Personal Data for purposes connected with our Services. As such, we will only retain your personal information for as long as necessary for those purposes. If you make a donation through our Website, we will keep your account open and retain your Personal Data for 7 years from the date of your last log-in. This is because we may need this data in some way to support a claim or defence in court. That is also the period within which our tax collecting authorities may demand to see and audit our records.

We regularly audit the personal information we hold and delete that which is not necessary. Personal Data collected from your applications to, and attendance at our events, is deleted after two years. Personal Data collected when you contact us for other reasons is deleted after two years.

Disclosing Personal Data

If we choose to sell, transfer, or merge parts of Encompass or our assets, we may disclose your personal information to the new owners. Alternatively, we may seek to merge with another charity. If a change like that happens, then the new owners may use your personal information in the same way as set out in this policy.

We are subject to the law like everyone else. We may be required to give information to legal authorities if they so request or if they have the proper authorization such as a search warrant or court order.

We also may need to retain and disclose certain personal information about you to regulatory authorities and to appropriate agencies to conduct anti-money laundering and trade sanction checks and to assist with fraud prevention. We will disclose this information as is required by law.

Security of Your Personal Data

Encompass is committed to protecting the Personal Data you share with us. We utilize a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Data from unauthorized access, use or disclosure. When your credit card information is transferred over the Internet, it is protected using Secure Sockets Layer (SSL) encryption technology. We also use PCI-compliant payment processors to avoid storing your payment details.

Linked Websites and Third Party Services

Our websites and services may provide links to other third-party websites and services which are outside our control and not covered by this policy. We encourage you to review the privacy policies posted on these (and all) sites you visit or services you use.

Discussion Groups and Chat Rooms

If you participate in a Encompass discussion group or chat room, you should be aware that the information you provide there may be made broadly available to others, potentially inside or outside Encompass, who have access to that discussion group or chat room. Also, please recognize that individual discussion groups and chat rooms may have additional rules and conditions. Each participant’s opinion on a discussion group or chat room is his or her own and should not be considered as reflecting the opinion of Encompass.

Embedded Community Box Privacy Policy (Talent Database)

In the following Policy, "we" refers to Fraction 7, Ltd, makers of Community Box

1. What data we store on your device

We do not store any data on your device.

2. What we track

We monitor activity in, and uploads to, Boxes. This is both to ensure there are no violations of the Terms and Conditions, or in order to comply with requests from law enforcement or other authorised government agencies.

3. What data we store

We store any data that is necessary for the display and processing of a Box (e.g., the box contents themselves, and any settings or customisations that have been made to the Boxes). We also store your contact details so that we can get in touch with you for purposes in connection with the business. We also store usage metrics in order for our internal teams to improve the Community Box experience.

4. What data we share

We are committed to your privacy and we do not share data with any 3rd parties, except in the case of requests from law enforcement and other authorised government agencies.

5. How we process your data

Your data is stored and processed in the form of reports, and real-time monitoring and metrics. These are used internally within our company to allow us to improve our services so we can improve the Community Box user experience.

6. How you can obtain and erase the data we store about you
